This abstract summarizes Holloway’s expert witness services on behalf of the design team in litigation between the plainitiff DIA hotel owners and the defendant design team and construction contractors.

Facts of the Case

The central issue of the case was the apportionment of liability and damages resulting from the owner’s agents’ failure to insure that sound insulation was installed in all hotel room party walls in each of the three hotels. That the insulation had in fact been omitted was not disputed.

Holloway’s Services

Holloway’s investigation found that the design team did not contract to perform the field QA/QC inspection services required to ensure that the construction was in total compliance with the contract documents. The owner’s had not contracted for, but instead had delegated to others and/or retained those services. Therefore, the design team could not reasonably be found to be at fault.

Decisions

The case was settled before trial.
