NGL PLANT AND NATURAL GAS PIPELINE, ILLINOIS
Construction Contract Dispute Summary
Fast-track construction of this $1 billion NGL plant and $1 billion Canadian natural gas pipeline was managed by the owner, Holloway Consulting’s client, on a prime contract basis with the assistance of a Not-At-Risk, CM Agent.
Litigation and a large number of large construction claims arose post-construction, including the electrical contractor’s claims. Holloway Consulting was retained in a litigation support role and analyzed and rendered written opinions regarding:
- Causation for the electrical contractor’s contribution to schedule delay and job cost growth, including lack of supervision, and labor supply problems;
- Whether or not the completion of electrical work drove the actual dates for systems turnover, and ultimately for start-up and commissioning;
- Whether or not work by other disciplines (piping, equipment, structural steel/ miscellaneous steel) had an impact on systems turnover, start-up, commissioning and commercial operations planned/actual dates; and,
- The value and composition of our client’s time-related damages and whether these damages were in whole, or in part, a consequence of this or other contractors’-caused delays.
Holloway Consulting Group’s Expert Witness Analysis and Report
Holloway Consulting performed a schedule delay analysis (schedule update analysis), craft labor productivity analysis (measured mile method) and construction damages analysis (modified total cost method) and issued an expert report in this litigation.
Holloway’s client achieved a very favorable settlement with the electrical contractor prior to trial.
