HWY. 93 HOOVER DAM BYPASS BRIDGE
This FHWA Project and resulting arbitration is also covered in another post in this blog at Highway and Bridge Construction. The “elevator-ride version” of this dispute centered around the collapse of the cableway system, or crane, mid-way thru construction. Following the collapse, the JV Contractor filed a $35,000,000 claim against their Builders Risk policy and a $75,000,000 breach of law suit against their cableway system supplier. One of the unique elements of this dispute is the highway contractor’s attempt to recover the same monies from both the cableway system supplier and the insurance carrier under Nevada’s collateral source payment rule.
Holloway was retained as the construction damages expert, schedule delay expert, and expert witness on behalf of the cableway supplier, who prevailed in all of his claims against the JV and defeated all of the JV’s claims.
