HURRICANES KATRINA, GUSTAV, AND RITA REPAIR DAMAGES: NEW ORLEANS
Holloway Consulting has worked and continues to work on a series of cases in New Orleans related to the exorbitant costs charged by contractors for cleanup of Katrina/Rita damage to education, school projects and other buildings. Holloway’s work is comprised of many elements, but perhaps the most relevant is our analysis and testimony related to anticipated cost of repair versus actual cost of repair, with the added element being that most of the work was performed under reimbursable contracts with a GMP.
MICROBIOLOGY RESEARCH AND DEVELOPMENT BUILDING: UNIVERSITY OF COLORADO
This case involved the General Contractor’s claim to the University for schedule delays and damages resulting from design-related issues such as approved and unapproved change orders, RFI’s, Change Order Proposals, etc.
SCIENCES COMPLEX, UNIVERSITY OF OKLAHOMA
Holloway Consulting was retained by the University to provide consulting and expert witness services regarding claims asserted in connection with the default on the electrical contract for the Sciences Complex. Holloway found that, at the time of default, the contractor’s work including materials stored on site was more than 90% complete, and that the CM met its responsibility as construction manager with regard to estimating the status of the completed work and reviewing the contractor’s applications for payment. However, the Surety’s decision to first bond and then abandon the contractor was inappropriate, and the Surety did not meet its responsibilities as surety in supervising and organizing the work after the default. The resultant delay to the completion of the project was the Surety’s responsibility. On the other hand, both the University and the Architect met their responsibilities with regard to estimating the status of the completed work and reviewing the contractor’s applications for payment.
