Holloway Consulting performed an expert analysis of alleged design and construction-related defects, as identified in the County’s expert’s report. The purpose of Holloway’s analysis was to provide an assessment as to the merits, if any, of the alleged defect claims and to establish initial estimated repair cost estimates associated with the correction work.

TRINIDAD CORRECTIONAL FACILITY, TRINIDAD, COLORADO

Holloway found that, under the circumstances if this project, although CDOC had various other inspection agencies such as the State, CM, Architect, and Structural Engineer, the General Contractor was or should have been aware that the presence of CDOC’s various on-site agents did not and would not relieve the General Contractor of such responsibility for the work. In Holloway’s opinion, had the General Contractor completed the project, the General Contractor was contractually obligated to correct any defects at the General Contractor’ cost. The costs associated with correcting the General Contractor-caused defects should fall to General Contractor’s/surety’s account, even if it is ultimately judged that CDOC wrongfully terminated its contract with the General Contractor.
