    What are the preferred qualifications of a Construction Damages expert?

    Construction-related Degree

    The Construction Damages expert should have one or more degrees in construction-related disciplines such as Construction Management, Architecture, or Engineering.

    Construction Industry Experience

    The Construction Damages expert should have extensive experience working in the corporate office and in field at the job site(s) during the construction of multiple projects, and should have experience developing and utilizing the following construction project documentation:

    1. Correspondence and other documents relating to contract negotiations;
    2. General Contract;
    3. Subcontracts;
    4. Correspondence;
    5. Requests for Information (RFI);
    6. Architect Supplemental Instructions (ASI), Proposal Requests, and any other such supplemental design instructions;
    7. Meeting minutes, notes, memoranda and other documents related to meetings between the Owner, Architect and/or General Contractor;
    8. Meeting minutes, notes, memoranda and other documents related to meetings between General Contractor and subcontractors, vendors, suppliers, etc;
    9. Personnel work diaries, journals, logs, daily field reports and similar documents;
    10. Copies of revisions to the drawings and specs in the contract set and logs of same;
    11. As-built plans and drawings and other documents depicting the as-built conditions of the project;
    12. Field construction sketches;
    13. Shop drawings, technical submittals and similar documents;
    14. Job progress photographs and videotapes;
    15. Documents relating to any contractor backcharges against subcontractors;
    16. Claims, liens, etc. with all related documents;

    The greater the diversity of projects, the greater the expert’s credibility. All too often we encounter opposing experts with little or no construction industry experience who encounter great difficulty achieving their desired results.

    Construction Project Controls Experience

    The expert should have extensive experience working in the construction industry positions and fields related to cost estimating, cost accounting, and planning/scheduling, and developing and utilizing the following:

    1. Contractor bid estimates, w/backup such as takeoffs, subcontractor bids, material quotes, quantity and pricing calculations, bid assumptions, bid exclusions, bid qualifications, etc.;
    2. Bid summaries and any comparisons of subcontractor and vendor quotes;
    3. Final Contractor Bid Proposals;
    4. Contractor’s periodic and final cost control budgets;
    5. Contractor monthly, periodic and final job cost reports;
    6. Contractor’s applications for payment to the Owner/client, w/backup documents;
    7. Subcontractor’s applications for payment to the Contractor, w/backup documents;
    8. Project schedules, both summary and detailed; CPM and bar-charts; both hardcopy and electronic such as Primavera Project Planner, Suretrak, Microsoft Project, etc;
    9. Contract change orders, change order requests, logs and similar documents;

    Construction Problem Causation Experience

    Determining budgeted costs, actual costs, and cost variances can often be a relatively simple task. On the other hand, determining the causes of the variances between planned and actual performance requires the type of experience outlined in this post.
