Holloway Consulting was retained in this casino/hotel dispute as the expert by the general contractor and its insurance carrier to investigate the causes and sources of water intrusion and mold infestation, and the resultant damage to work in place, hotel schedule delays and claims.
PARAGON HOTEL/CASINO, LOUISIANA
The case involved mold infestation during construction of the hotel/casino, which caused the work in-place to be torn-out and replaced. Working as the expert, Holloway found that the Contractor was responsible for construction means and methods, scheduling and coordinating the work, and ensuring that the work was performed according to industry standards and the contract documents. The Contractor’s improper sequencing of construction work, and inadequate control of construction-related moisture contributed significantly to the introduction of moisture and mold in the hotel. For example, contrary to industry practices, the Contractor finished the ground floor first, and then completed the upper floors. The Contractor also hung drywall before the building was dried-in, and the Contractor failed to ensure that draft stop was installed in the building attic. These and other Contractor-caused factors resulted in mold and the related damages.
NORTHERN WINZ CASINO, MONTANA
Holloway Consulting was retained by counsel for the GC to provide consulting and expert witness services relating to the design and construction of the Northern Winz Casino and the subsequent arbitration. The primary issue in the arbitration was whether or not the Owner’s termination of our GC client was wrongful, for convenience or for cause. The panel agreed with Holloway’s testimony on causation and damages and awarded our client all incurred costs plus markup.
